Goodman and Fehr Prevail in Missouri Supreme Court
Mark E. Goodman and Amy L. Fehr prevailed in the Missouri Supreme Court in a suit to establish insurance coverage. Mark and Amy obtained judgment in the amount of $840,000.00 for the wrongful death claim of the widow of a man killed while operating heavy machinery.
The insurance company denied coverage for the judgment under the policy’s employee exclusion. Because Missouri law was silent, and courts across the country were split in their interpretation of the exclusion, the case was transferred to the Missouri Supreme Court. Adopting CSGS’ argument, the Court found in favor of the widow, holding that her deceased husband was a temporary worker and not an employee excluded under the policy.
